F-GAS: the DPR 146 / 2018 published in the Official Gazette, in force since 24 January 2019

It was published in the Official Gazette n.7 of the 9 January 2019 the Decree of the President of the Republic 16 November 2018, n. 146 on "Regulation for the implementation of regulation (EU) no. 517 / 2014 on fluorinated greenhouse gases and repealing Regulation (EC) no. 842 / 2006 ".

The provision repealing the 43 / 2012 DPR 24 January 2019 will come into force.

THE DATA BANK IS BORN fluorinated greenhouse gases and equipment containing such gases

The sales of fluorinated greenhouse gases and of equipment containing these gases as well as the activities of assistance, maintenance, repair and dismantling of said equipment, must be communicated, electronically, to the Database managed by the competent Chamber of Commerce, upon registration to tele register. In particular:

Sale to end users - Companies supplying non-hermetically sealed equipment containing fluorinated greenhouse gases to end-users, irrespective of the mode of sale used, including distance communication techniques, starting from the sixth month following the date of entry into force of this decree ( from 24 July 2019), will have to communicate to the database, at the time of sale and by computer, the following information:
- type of equipment;
- number and date of the invoice or sales receipt;
- registry of the purchaser;
- declaration of the purchaser bearing the commitment that the installation will be carried out by a company certified under the provisions of Article 10 of Regulation (EU) no. 517 / 2014; alternatively, if the purchaser coincides with the certified company, the certificate number of the same and the registry of the final user. In cases where the seller offers the end user the installation service of the equipment sold, the declaration is issued by the seller.

Installation, leakage control, maintenance, repair and dismantling - From the eighth month following the date of entry into force of this decree (from 24 September 2019), the company or the certified natural person, following the installation or the first loss control, maintenance or for the repair of equipment containing fluorinated greenhouse gases, it must communicate the following information to the database electronically:
- number and date of the invoice or purchase receipt of the equipment (only for those who install it);
- the registry of the operator;
- date and place of installation;
- type of equipment;
- unambiguous identification code of the equipment;
- quantity and type of fluorinated greenhouse gases present and possibly added during installation or during inspection, maintenance or repair;
- name and address of the recycling or regeneration plant and, where appropriate, the certificate number, if the quantities of fluorinated greenhouse gases installed have been recycled or regenerated;
- identification data of the certified natural person or of the certified company that carried out the installation or the control, repair or maintenance intervention;
- any comments.

Equipment dismantling: from the eighth month following the date of entry into force of this decree, the certified company or natural person shall communicate the following information to the database electronically:
- date and place of dismantling;
- the registry of the operator;
- type of equipment;
- unambiguous identification code of the equipment;
- quantity and type of fluorinated greenhouse gases recovered during dismantling;
- measures taken to recover and dispose of the fluorinated greenhouse gases contained in the equipment;
- identification data of the certified natural person of the certified company that carried out the dismantling operation;
- any comments.

Information regarding loss control, installation, maintenance, repair or dismantling must be communicated electronically to the database within 30 days from the date of intervention.
