On the Official Journal of the European Union series L197 of July 24 2012 the new Directive 2012 / 19 / EU WEEE Waste Electrical and Electronic Equipment was published. Formally, the Directive 2012 / 19 / EU will enter into force next 13 August while the current WEEE Directive 2002 / 96 / EC will be permanently repealed with effect from February 15 2014.
By February 14 2014 Member States will accordingly issue the corresponding decree of national transposition.
Annex I) contains a list of the categories of electrical and electronic equipment immediately covered by the new directive: to note the inclusion of photovoltaic panels.
Annex III) contains the list of all equipment that, six years after the entry into force of the new WEEE, will be subject to the Directive. In principle, all electrical and electronic equipment will fall within the scope of (open scope) if not explicitly excluded (or falling in the conditions to be included).
Annex IV) contains a non-exhaustive list of equipment that fall into these categories.
The definition of EEE remains unchanged (Article 3 1 paragraph; it will be important to monitor the interpretation to be given by the Commission for the effective evaluation of the impact of the new directive on the products currently excluded from the scope.
