The 21 / 2017 / EU Directive has been published on the European Official Gazette of November 2102 / XNUMX, which partially modifies the RoHS Directive II (Restricted Use of Certain Dangerous Substances in Electrical and Electronic Equipment).
The main purpose of the new legislative provision is to adapt the text of RoHS Directive II to the legislative framework regulating the placing on the market of products
The main novelties that will be introduced by the 2017 / 2102 / EU Directive are as follows:
• deletion of Article 2, paragraph 2 and amendment of Article 4, paragraph 3: clarified that the date of application for new EEE within the scope of the 2 RoHS Directive is 22 July 2019 and that operations on the so-called "market secondary "for such equipment will still be possible after that date;
• amendment of Article 3, paragraph 28: new definition of "non-road mobile machinery" and, consequently, clarification on this exclusion;
• inclusion of clarifications regarding derogations for spare parts, periods of validity of exemptions and the procedure for granting, renewing or revoking them.
The 2017 / 2102 / EU Directive will enter into force on 11 December 2017 and must be transposed by Member States by 12 June 2019.
